Modifying Custody, Visitation & Support Orders


Modifications of existing child custody and visitation orders or decrees are dealt with differently under Nebraska law. For example, the party seeking the modification has the burden of proving that a material change in circumstances has occurred since the entry of the last order or decree. Even if a material change is indeed proven, the court still will not automatically grant a modification. The court must still evaluate the individual facts and circumstances of the case to determine whether the modification is in the best interests of the children.
